Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the ASH.STUDIO salon CRM platform operated by ASH Studios, LLC, a Utah limited liability company (“we,” “us,” or “ASH.STUDIO”). By signing up or using the platform, you agree to these Terms.

1. Your account

You must be at least 18 years old and have authority to bind the business you’re signing up on behalf of. Keep your login credentials secure and let us know immediately if you suspect unauthorized access. You’re responsible for everything that happens under your account.

2. Free trial and billing

• Every new plan starts with a 14-day free trial.
• A valid payment method is required to start the trial, but you’re not charged until day 15.
• Cancel anytime during the trial from your billing dashboard and you won’t be charged.
• After the trial, your subscription auto-renews at the monthly or annual price shown on our Pricing page until you cancel. Annual plans are billed once per year at an 8% discount versus monthly.
• Fees are non-refundable except where required by law. If your payment method fails, we’ll retry a few times and then suspend access until payment is resolved.

3. Data ownership

You own your salon data. Client records, consultation responses, notes, appointments, and any content you or your team creates inside ASH.STUDIO remains yours. We use your data only to provide the service to you and process it under your instructions.

You can export your data at any time. If you cancel, we retain your data for 30 days to allow reactivation, then delete or anonymize it.

4. License to use ASH.STUDIO

Subject to these Terms, we grant you a non-exclusive, non-transferable, revocable license to use ASH.STUDIO for your salon business during your subscription. You may not resell the platform, reverse engineer it, or use it to build a competing product.

5. Acceptable use

You agree not to:

• Send unlawful, harassing, deceptive, or unsolicited messages through the platform.
• Send SMS or email to recipients who have not consented, or after they have opted out.
• Upload malware, attempt to breach security, or interfere with other tenants’ use of the service.
• Violate any applicable law, including telemarketing regulations (TCPA), anti-spam laws (CAN-SPAM), and privacy laws.
• Impersonate another person or misrepresent your affiliation with a business.

We can suspend or terminate accounts that violate this section without notice.

6. Third-party services

ASH.STUDIO integrates with third-party services (Clerk, Stripe, Twilio, Resend, Neon, Vercel, Phorest, and others). Their terms also apply to your use of those services through our platform. We aren’t responsible for their availability or behavior.

7. Availability

We work hard to keep ASH.STUDIO fast and reliable, but we don’t promise uninterrupted service. We may perform maintenance, update features, or deprecate parts of the platform. We’ll give reasonable notice for material changes.

8. Termination

You can cancel your subscription at any time from your billing dashboard. We can terminate or suspend your account for violation of these Terms, non-payment, or if we’re required to by law. Upon termination, your license ends and we’ll delete your data per section 3.

9. Disclaimers

ASH.STUDIO is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, ASH.STUDIO’s total liability for any claim arising out of or relating to these Terms is limited to the amount you paid us in the 12 months before the claim. We’re not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost data.

11. Indemnification

You agree to indemnify and hold ASH.STUDIO harmless from claims arising out of your use of the platform, your content, or your violation of these Terms or applicable law.

12. Governing law and venue

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Salt Lake County, Utah, and you consent to that jurisdiction.

13. Changes to these Terms

We’ll update these Terms as the platform evolves. Material changes will be announced by email to account owners. Continued use after changes means you accept them.
